Divorce does not end financial obligations — it reorganises them. In Malaysia, divorcing spouses have access to a range of financial claims that differ significantly depending on whether the marriage was civil or Islamic. Understanding which claims apply to your situation, and in which court to pursue them, is the first step to protecting your financial future. The most significant claims to know about are harta sepencarian (matrimonial property division), nafkah iddah (maintenance during the waiting period after Islamic divorce), mut'ah (consolatory payment for wives), and spousal maintenance under civil law.

Harta sepencarian is unique to Islamic law and covers assets acquired jointly during the marriage through mutual effort. Courts typically award the non-earning or lower-earning spouse between one-third and one-half of jointly acquired assets — but the precise share depends on each spouse's financial and non-financial contributions. Under civil law, matrimonial property is divided according to the court's discretion under Section 76 of the LRA 1976, which also considers contributions including homemaking and child-rearing. EPF savings accumulated during the marriage may also be subject to division in both civil and Syariah courts.

For Muslim wives, nafkah iddah — maintenance payable by the husband for the three-month iddah waiting period — and mut'ah — a consolatory gift — are Islamic obligations that Syariah courts can enforce.
