What Affects Child Maintenance in Malaysia?

Income of Both Parents

Courts consider both parents’ earning capacity when determining maintenance. The higher the combined income, the greater the expected standard of support for the child.

Standard of Living

Children are entitled to maintain the standard of living they enjoyed before the divorce. Courts aim to minimise disruption to the child’s lifestyle.

Children’s Needs

Education fees, medical expenses, extracurricular activities, and special needs are all factored in. Older children and those with disabilities typically receive higher maintenance.

Number & Ages

More children means a higher total maintenance obligation, but per-child amounts may decrease. Older children and tertiary students generally cost more.

Custody Arrangement

Shared custody can reduce the maintenance amount since both parents contribute directly to daily expenses. Sole custody places the financial burden more heavily on the non-custodial parent.

Civil vs Syariah

In Syariah courts, the father bears the primary obligation to maintain his children regardless of the mother’s income. Civil courts consider both parents’ financial capacity.
